My stance: Unconstitutional, should be removed from United States Law
My argument: If the accused is innocent, indefinite jail time before the trial could force the accused to confess to a crime that he/she never committed. If the accused is guilty, there should be enough evidence to prove that by the time the accused is arrested. If otherwise, you could just keep the accused under surveillance with the justification being the evidence that has already been collected. I believe that this law opens the door to arrests made not on the basis of evidence, but on the basis of prejudice. Finally, the law clearly violates the Sixth Amendement.

I know it's unconstitutional, but the senate voted for it 93-7.

No worries, it'll be overturned by the Supreme Court.

But it looks like they have more than enough votes to make it a new constitutional amendment O_o

It was passed because it came with the defense bill, and the last thing congress wants is another budget showdown. Yet, they don't want too repeal something they passed. And, in my opinion, the Supreme court will not overturn it so easily, considering what they did with Guantanamo for all these years.
